What is the terms and conditions document?

This document is an agreement between you and the Eihal mobile application, and this document contains all the terms and conditions that you must adhere to and work under when using our websites, platforms or applications on the Internet. These terms apply to all visitors, users and others who access or benefit from the service. By accessing or using the service, you agree to all the terms and conditions mentioned below without exception. If you do not agree to all or part of the terms and conditions, you must exit and not use the service. These terms and conditions may be subject to amendment or change, and we are not required to notify you of this and you must review the terms and conditions periodically. Your continued use of the service is considered full acceptance of the terms and conditions applicable during the period of your use of the service.

Terms of use

You must be at least 18 years old and have full legal capacity to contract and deal, register or visit the platform or application, and if you are under 18 years old, you must obtain the approval of your parents or guardians.
You must comply with all applicable laws and regulations in the Kingdom of Saudi Arabia.
That your use of the Referral Services has not been suspended at any time.
Provide correct and accurate information when registering or using our services and update it periodically.
You will not interfere with the proper operation of the Services, or attempt to harm the Platform or the Application.
You are not a competitor to the Referral Application or Platform and do not offer similar or identical products.
You undertake to keep your account passwords and all means of identification that we will provide to you secure and confidential.
You are solely responsible for any losses or damages that may arise as a result of your providing incorrect or insufficient information.
You are solely responsible for all opinions, ideas, and personal data that you provide while using Eihal Services, as well as for all personal information submitted.
You shall not send any messages that are threatening, immoral, racist, or contrary to local laws and international agreements. Any correspondence, addresses, or pseudonyms must not violate regulations, public morals, good behavior, and laws.
Your commitment not to harass or threaten other users, any of the customer service employees of the Ihhal application and platform, or any of the medical practitioners present on the platform or application.
Your consent to the exchange of information between companies and regulatory bodies cooperating with Eihal regarding your operations carried out and the evaluation of dealings with you.
Your obligation not to modify, extract, translate, summarize, create a derivative work based on, reverse engineer, or otherwise identify or attempt to identify or attempt to access the source code, internal design of the Services, or any text, multimedia images (photos, audio, video files), data or other information provided by Eihal or third party service providers.
Eihal application and platform has the right to refuse to provide the service or prevent you from using the service without giving reasons.
Eihal is designed to support your health decisions and the choices you make. We can only help you find good health information, whenever it is available and appropriate. Eihal is a technology facilitator and should not be considered an app to provide medical or health care services or a substitute for health insurance, a treating physician, or visits to your personal physician.
Your commitment not to use the site or application to carry out any commercial or advertising activities not authorized by the owner company, or to extract the contents of the site or application for commercial or advertising purposes.
Other than the personal information covered in the Eihal Platform and Application Privacy Policy, any material you post or submit on the Platform and Application will be considered non-confidential and non-personal, and the owner company will have no obligations regarding such material.

Intellectual Property

All intellectual property rights in the Eihal Platform and Application and all materials related to or appearing on it (including any content provided or posted by Eihal and all content uploaded to the Site or Application) are owned by Eihal Platform and Application, and Eihal has the right to dispose of this property as it pleases. You must not reproduce or allow anyone, for any reason, to use or reproduce the Services, or any trademarks or other trade names appearing on the Services.

Compensation

By agreeing to the Terms of Service and using the Service, you acknowledge and agree to indemnify the Owner Company and/or any of its affiliates, officers, directors, employees, users, lawyers, agents, affiliates, licensors, and entities and individuals directly contracting with it against claims, costs, damages, losses, liabilities and expenses (including legal fees and costs) arising from or related to any breach of the aforementioned terms or the laws and regulations in force in the Kingdom of Saudi Arabia.

Contests and Promotions

Any contests or promotions (or similar) available on the Eihal Platform and App may be subject to terms and conditions that differ from these Terms. If you participate in contests or promotions, please consider the applicable rules as well as our Privacy Policy. If the rules of the promotion conflict with these Terms, the rules of the promotion will apply.

Cancellation and Refund

Eihal platform and application does not have the right to refund the value of the service after completing the payment, and the refund is requested through the doctor or the center providing the service, as the Eihal platform and application are only an intermediary for arranging the appointment and referral between the beneficiary and the service provider.

Availability of the Application and Website, Errors and Inaccuracies

Due to the possibility of electronic services being subject to collapse or interruption, access to the Eihal platform and application is provided as is and in its current state only. Offers and products in the Eihal application and platform are constantly updated. Products may be misdescribed or inaccurately priced, and we may experience some delays in updating information on the service or in our advertisements on other platforms. We cannot guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and correct errors, inaccuracies, or omissions at any time and without prior notice.

Communication methods

All approved communication channels on the Eihal platform and application are mentioned on the Contact Us page, and we are not responsible for any damages resulting from communicating with any other unapproved communication channels.

Purchases/Payment

In the event that you wish to pay for any product or service, you may be asked for certain information relevant to your payment process. The User represents and warrants that: (1) you have the legal right to use any credit card(s) or method (2) the information you provide to us is correct and complete. By providing such (other) payment methods in connection with any payment process; (information), you grant us the right to provide the information to a third party in order to facilitate the completion of the payment process. We reserve the right to refuse or cancel your order at any time for certain reasons including but not limited to: product or service availability, errors in the description or price of the product or service, if an error has occurred in your order or for other reasons.

Responsibility of the platform and application of referral

Subject to the responsibilities stipulated by law and which cannot be excluded, the owner company and each of its affiliates, officers, directors, employees, users, lawyers, agents, affiliates, licensors, parties and individuals directly contracting with it shall not be liable for any losses, damages, liabilities, claims, or costs (including without limitation and without limitation legal costs and defense fees or settlement costs) in any way, whether directly or indirectly resulting from your use of the Eihal platform and application or as a result arising from or due to access to the Eihal platform and application by you, or content, or a third party website and application, or third party services, in any way resulting, whether in contract, tort (including negligence), law, or otherwise.

We are committed to making every reasonable effort to provide the Eihal Platform and Application with all reasonable care. Except as required by law, we are not responsible for the quality, accuracy, or fitness for a particular purpose of the Eihal Platform and Application and we do not promise that the material contained in the Platform or the Site, or any of the functions contained in the Eihal Platform and Application or any of its servers will operate without interruption or delay or be error-free, or free of viruses or bugs or work in harmony with any other software or material.

We are not responsible for the conduct or content of any third party available on the Service. We are not responsible for any content obtained from the Service.

Eihal Platform and Application does not own and assumes no responsibility for the content, privacy policies or practices of any third party websites or services. You further acknowledge and agree that Eihal Platform and Application shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such websites or services. We strongly urge the user to read the terms and conditions and privacy policies of any third party websites or services that you visit.

Applicable law

The laws of the Kingdom of Saudi Arabia, without regard to its conflict of law provisions. These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Failure to enforce any right or provision of these Terms shall not be deemed a waiver of such rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding the Service provided by us, and supersede any prior agreements we might have between us regarding the Service. Any disputes or claims in connection with the Ehhal Platform and Application shall be subject to the laws applicable in the Kingdom of Saudi Arabia, as applied in the city of Riyadh.
